2. Definitions

Wildhearts: The company Wildhearts, registered with the Chamber of Commerce, offering sports-related services.

Member: A natural person who has entered into an Agreement or Membership with Wildhearts.

Services: All services offered, including group classes, open gym, personal training, workshops, and clinics.

Member Portal: The online platform or mobile app granting members access to bookings, payments, and information.
-
Agreement: The written or digital agreement between Wildhearts and the member concerning the membership.
3. Applicability

These terms and conditions apply to all agreements between Wildhearts and its members, including trial classes, memberships, and class passes.

Deviations from these terms are only valid if agreed upon in writing.
4. Memberships and Class Credits
Memberships
-
Wildhearts offers various monthly memberships, annual memberships, class passes, and a paid trial class. Details are available on the website and in the member app.

Monthly memberships are automatically renewed indefinitely. Annual memberships automatically convert to monthly cancelable memberships at an adjusted rate upon expiration.

The notice period for cancellations is one full calendar month. Cancellations made via channels other than the member portal or app will not be processed.

Wildhearts reserves the right to terminate a membership immediately in the event of house rule violations or non-payment. Refunds are not applicable in such cases.
Class Credits

Members receive a specific number of class credits per month based on their membership type. Unused credits do not carry over to the following month unless otherwise specified.

Class credits are strictly personal, valid for one month from issuance, and non-transferable.
5. Payment
Payment Terms
-
Membership fees are collected monthly during the first week of the month via direct debit. Direct debit is mandatory for memberships.

Class passes can be paid for online via iDEAL or credit card, or in person using cash, debit card, or credit card.
Late Payments and Penalties
-
A reminder will be sent in case of late payment. If payment is not made within two weeks, a €25 fine will be imposed to cover administrative costs.

In case of further non-compliance, a debt collection agency will be engaged, with all associated costs borne by the member.
Special Cases
-
Early termination of an annual membership will result in the price difference between annual and monthly memberships being charged for the months already elapsed.

Wildhearts reserves the right to adjust fees. Members will be notified in writing at least four weeks in advance of any changes. During this period, members may cancel their membership with a notice period of one full calendar month.
6. Price Adjustments

Wildhearts reserves the right to periodically adjust prices. Changes will be announced at least four weeks in advance via email, newsletter, or the member app.

In case of a price increase, members may cancel their membership in writing within this period, subject to a notice period of one full calendar month.

Price changes due to legal amendments, such as VAT increases, may be implemented immediately and do not warrant cancellation rights.
7. Obligations of Wildhearts

Wildhearts ensures that all classes and facilities meet the agreed standards of quality and safety.

Equipment is maintained regularly, and sufficient first aid supplies are provided.

Coaches and trainers are certified and possess the required expertise.
-
Members will be informed in a timely manner about changes to opening hours, schedules, or classes.
8. Obligations of Members
-
Members must disclose any medical conditions, injuries, or health issues to Wildhearts beforehand.

Members are required to adhere to house rules and instructions from the coaches.

Using equipment under the influence of alcohol, drugs, or other prohibited substances is strictly forbidden.
-
Changes in contact details, such as address, email, or phone number, must be communicated promptly.
9. Complaints Procedure

Complaints regarding Wildhearts’ services can be submitted in writing or via email.

Wildhearts aims to resolve complaints within 14 days of receipt. If a complaint cannot be resolved within this timeframe, the member will be informed with an estimated resolution timeline.

If a complaint cannot be resolved through mutual agreement, it may be referred to a dispute resolution committee or a competent court.
10. Dispute Resolution

Disputes arising from the agreement or membership will preferably be resolved through mutual consultation.

If this is not possible, disputes may be referred to a dispute resolution committee or the competent court.

Dutch law applies to all agreements.
11. Mandatory Use of the Booking System
-
Members are required to use the online booking system to reserve classes.
-
Wildhearts reserves the right to deny access to classes if this obligation is not met.
-
Cancellations within 12 hours of the scheduled start time will result in the loss of the used credit without reimbursement.
12. Promotions and Campaign Conditions
-
Wildhearts regularly organizes promotions and campaigns. The terms for each promotion will be communicated in writing.

Discounts and offers cannot be combined and are only valid within the specified promotional period.

Wildhearts reserves the right to modify or terminate promotions and campaigns prematurely.
13. Use of Facilities
Opening Hours and Access

Opening hours and class schedules are available on the website and in the member app.
Rules for Use
-
Clean indoor shoes and t-shirts are mandatory.
-
Only sealable water bottles are allowed; glass bottles are prohibited.
-
Members are encouraged to use a towel and must clean equipment after use.
-
The use of liquid chalk is prohibited.
-
Mobile phones are not permitted in the training area unless agreed upon with a coach.
Personal Belongings
-
Lost items will be stored in the "lost and found" for one month and will then be discarded or donated.
Age Restrictions
-
The minimum age for participation is 18 years.
14. Privacy and Data Protection
Privacy Policy

Wildhearts’ privacy policy can be viewed on the website and complies with the GDPR.
Use of Media
-
By agreeing to these terms and conditions, members consent to the use of photos and videos for promotional purposes. Written objections can be submitted via email.
Communication
-
Communication will be conducted via newsletters and notifications in the member app. Members may opt out at any time.
15. Force Majeure
-
In the event of force majeure, Wildhearts will endeavor to provide a suitable alternative. Regardless of the situation, the standard cancellation terms remain in effect.

Force majeure includes circumstances such as pandemics, natural disasters, government measures, technical failures, or other unforeseen events beyond Wildhearts’ control.

If the force majeure situation persists for more than two months, both Wildhearts and the member have the right to cancel the membership with a one-month notice period.
-
No refunds will be granted if reasonable alternatives are offered during the force majeure period, unless prevented by external circumstances.
16. Final Provisions
-
Dutch law applies to these terms and conditions.
-
Disputes will be handled by the competent court.
-
If any provision of these terms is deemed invalid, the remaining provisions will remain in full effect.
